  Land Use Regulations  
   

1.0  Land Use Classification

The Draft Master Plan contains the following Land Use Zones:

1. Residential Use zone
Existing Village Sites /settlements (as per Draft Plan)
Residential Areas

2. Commercial Use Zone
Commercial cum Offices
Commercial Cum Housing*

3.Public and Semi-Public Use Zone
(includes computer software units on individual plots)

4. Manufacturing Zone

5. Recreational Use Zone

6. Water Bodies Zone

7. Transportation Use Zone

* Please refer the category “Residential Use Zone” in Regulations for permissible activities in ‘Commercial cum Housing Zone’.

Where the use of a site is specifically designated on the Development Plan, it shall be used only for the purpose so designated.

a. Where a site is designated for one specific public purpose on the Development Plan, the Authority, for reasons recorded in writing and to avoid hardship, may allow the structures to be built thereon or permit the use of the structure in combination with other purposes, provided the same is in conformity with the overall rules and the zone in which the site falls.

b. In the case of special designation in Development Plan for schools and their playgrounds or markets and service industries, the Authority may interchange their use provided the designations are on adjoining or nearby building premises subject to the boundaries of the sites being within reasonable distance.

c. Where the use of a plot is essentially designated for open markets, the Authority, may permit development work on upper floors, which will be in conformity with the zone in which the plot falls.

d. Construction of multi-storied garages for parking will be encouraged on parking lots with suitable commercial mix incentive to be decided by CDA on case-to-case basis.

e. All uses permitted in Residential Use zones will be permitted in Existing village sites in addition to household industries.

2.0 General Provisions

3.0. 

Where the use of buildings and premises is not specifically designated on the Master Plan, it shall be in conformity with the zone in which they fall.

Provided that any lawful use of premises existing prior to the date of enforcement of these DCR shall continue up to the period as may be specified in the Master Plan.

Provided further that a non-conforming use shall not be extended or enlarged except as provided in the DCR for non conformity uses and that if a building of non-conformity use is pulled down or fallen down, the use of the new building shall be in conformity with the proposed DCR & Master Plan.

4.1.   Residential Use Zone
          Residential Areas
          (Also incorporating ‘Commercial cum Housing’ Areas)

4.1.1.  GENERAL PROVISIONS.

a.  All Residential uses are permitted in Residential Use Zone, subject to conformity with building regulations contained in these DCR.

b.  The uses other than residences as listed in  4.1.2 shall be permissible only on ground floor of the building provided that the plot size is at least 1500 sqm and the abutting road has an existing  width of not less than 12 m. The maximum permissible built-up area for commercial use shall be 10% of the permissible ground coverage.

c.      The uses other than residences as listed in 4.1.3 shall be permissible only on ground floor of the building provided that the plot size is at least 1500 sqm and the abutting road has an existing  width of not less than 18 m. The maximum permissible built up area for commercial use shall be 20% of the permissible ground coverage.

d. Where the building or premises abut on two or more streets, no direct opening of shops shall be permissible on the street on which no shopping is allowed.

e. All goods offered for sale and bought for repairs shall be displayed and kept within the building and shall not be kept in the passages or footpaths or road.

f.  No trade and business involving any danger of fire, explosion, offensive noise, vibrations, smoke, dust, glare, heat or other objectionable influence may be allowed.

g. Parking, covered as well as surface, shall be provided as specified with adequate provision for entry and exit of vehicles.

h. Minimum margin of 6.0m shall be provided along the sides abutting the street and shall not be included in the mandatory open space provision within each plot.

4.1.2.  The following uses shall be permissible in Residential Use Zone only on ground floor of the building provided that the plot size is at least 1500 sqm and the abutting road has an existing  width of 12 m or more. The maximum permissible built up area for commercial use shall be 10% of the permissible ground coverage.

1. Medical and Dental practitioner’s dispensaries, but only on ground floor of the building or on first floor of the building where the buildings is on stilts and shall not abut a road less than 12m wide.

2. Professional offices and studies of a resident of the premises and incidental to such residential use.

   4.1.3 The following shall be permissible in Residential Use Zone only on ground floor of the building provided that the plot size is at least 1500 sqm and the abutting road has an existing width of 18 m or more. 1.     Stores or shops for the conduct of retail business but not including departmental stores. Storage and sale of combustible materials shall not be permitted

2.     Branch offices of banks with safe vaults, electrical substation, fire station, civil defence warden post and fist-aid post along with home guards and civil defence center, pumping stations, and water installations and ancillary structures thereof required to cater to local area.

3.     Educational buildings including hostels, religious buildings, community halls, welfare centres and gymnasiums, except trade schools.

4.     Personnel services establishments.

5.     Hair dressing saloons and beauty parlours.

6.     Shoe repair and shinning shop.

7.     Shops for collection and distribution of clothes and other materials for cleaning, pressing and dyeing establishments.

8.     Tailor shops not employing more than 9 persons and embroidery shop and button hole making shops not employing more than 9 persons with individual motors not exceeding 1 HP and total HP not exceeding 3 HP.

9.     Shops for gold smiths, lock smith, watch and clock repairs, bicycle rental and repairs, musical instrument and repairs, picture framing, radio and other household appliances repairs, umbrella repair and upholstery employing not more than 9 persons with individual motors not exceeding 1 HP and total HP not exceeding 3 HP.

10.   Pan shops, dhobi shops for collections and distribution of clothes and other materials for cleaning and dyeing establishments, darners, tailors, groceries, confectionaries and general provision.  Hairdressing saloon and beauty parlour, bicycle hire and repairs, vegetable and fruit stalls, milk shops, dispensaries, florist, bangles and other articles, small bakeries, newspaper stalls.

11.   Coffee grinding with electric motive power not exceeding 1 HP.

12.   The flourmills and grinder and production of eatables, with special permission from the authority.

13.   Preparation and sale of eatables in eating-houses.

14.   Sale of used or second-hand goods or merchandise (not junk, cotton waste, rage or other materials of offensive nature).

15.   Storage of furniture and household goods.

16.   Repairs of all household articles (excluding automobiles).

17.   Repair, cleaning shops and analytical experimental or testing laboratories not employing more than 15 persons in industrial activity but not including cleaning and dyeing establishment using a cleaning and dyeing fluid having flash point lower than 60 o C and machines with dry load capacity of 30 kg. for any establishment carrying activities that are obnoxious or offensive because of emission odour, dust smoke, gas, noise or vibration or otherwise dangerous to public health and safety, provided that the motive power requirement of the establishment does not exceed 10 HP.

18.   Research, experimental and testing laboratories not involving any danger neither of fire or explosion nor of any obnoxious nature and located on a site not less than 4 hectares in area and when the laboratory is kept at least 30m from the residential building.

19.   Restaurants, eating houses, cafeterias, ice cream and milk booth.

20.   Establishments for preparation and sale of eatables not occupying production area in excess of 75sqm. with motive power not exceeding 3 HP.

21.   Trade and other similar schools not involving danger of fire of explosion nor of offensive noise, vibration, smoke, dust, odour, glare, heat or other objectionable influences.

22.   Flour mill not using more than 10 HP motive power.

23.   Battery charging and repairing not employing more than 6 persons with an area not more than 25 sqm. and not more than two charges with power not exceeding 5 HP.

24.   Photography studios and laboratories with an area not more than 50sqm. and using power more than 3 HP.

25.   Showrooms for distribution and booking of LPG gas provided no storage is permitted.

26.   Coal, fire wood shop.

27.   Group medical centers on several floors, preferably ground floor.

28.   Residential Hostel – On independent plot with no floor restriction.

29.   Medicine and chemist shops.

30.   Any other activity not covered herein but which in the opinion of CDA may be similar in nature to the broad group.

The Authority may from time to time add to, alter or amend the above list with the approval of the Government.

4.1.4.   Uses permitted on individual premises / buildings in Residential Zone:

The following uses shall be permitted in residential zone on individual premises provided the minimum existing road width is 18.0m and the minimum plot size is 1500sqm. The maximum permissible built up area for commercial use shall be 30%.


1. Computer Software Units for the entire building.
2. Petrol filling and service stations not employing more than 9 persons and subject to appropriate building regulations and site restrictions.
3. Hospitals, nursing homes, maternity homes & veterinary clinics.
4. Trade and other similar schools.
5. Bulk storage of kerosene and bottled gas for domestic consumption with special permission of the Authority and after clearance from competent authorities dealing with such storage licenses.
6. Parking of automobiles and other light vehicles on open plots as business.
7. Vegetable, fruit, flour, meat market.
8. Boarding and lodging houses.
9. General agriculture and horticulture (including domestic poultry).
10.  Photographic studios and laboratories not using more than 5 HP and not employing more than 9 persons.
11.   Hotels 3 star and above category provided that the road width is at least 36m and the plot size is at least 2500Sqm.

The Authority may from time to time add to alter or amend the above list.

4.1.5.    Commercial Cum Housing

This is a zone as specifically indicated on the Draft Master Plan on major arterial roads having road width 24m and more.

This is meant for large showrooms, corporate offices, supermarkets, software units (entire building), hotels, restaurants and other commercial activities of high order with minimum plot size of 2500Sqm. The maximum permissible built up area for commercial use shall be 40%.

4.2.     Commercial Use Zones

(This zone is indicated on the Draft Master Plan only on roads having proposed width of  36m and above. In this Zone buildings can be used for commercial purpose to the extent of 100% of built up area).  The existing road width must be 12m or more.

4.2.1   General Provisions

In commercial Cum Office zones, buildings or premises shall be used only for the uses and purpose given herein subject to the following conditions. Residential uses may be permitted.

a. Where the building or premises abut on two or more streets, no direct opening of shops and other uses shall be permissible on the street of width less than 36.0m.

b. No trade and business involving any danger of fire, explosion offensive noise, vibrations, smoke, dust glare heat or other objectionable influence may be allowed.

c. Parking, covered as well as surface, shall be provided as specified.

d. For plot sizes above 5000sqm, provisions under the land subdivision rule or layout shall be followed.

4.2.2.  Uses permitted on roads having proposed width of 36 m and more but less than 60m.  The existing road width must be 12m or more.

1.   All Commercial Uses.

2.   Any use permitted in the residential zone with shop lines without area and floor restrictions.

3.   All activities permitted under 4.1.3 and 4.1.4.

4.   Other minor or domestic industrial activity such as diamond cutting, mattress making, gem & jewellery provided they do not cause noise and other pollution.

4.2.3.  Uses Permitted on Roads having proposed width of 60m and above. (uses under 4.2.1 are not permitted).  The existing road width must be 12m or more.

1. All commercial uses.

2. Wholesale establishments with an area not exceeding 2500 sqm. subject to fire protection requirements.

3. Printing, book binding, engraving and block making on unrestricted scale and motive power if the same are in independent building, subject to any special conditions to be prescribed by the Authority in the interest of the adjoining development.

4. Major public utility buildings.

5. Headquarters of Organisations.

6. Cleaning and pressing establishment for clothes.

7. All Hotels.

4.3.   PUBLIC AND SEMI-PUBLIC USE ZONE

In this zone following uses are permitted

i.    All computer software units with adequate parking.

ii.    Police stations or Chowky, Post office, Library, Town hall, telephone exchange and fire station.

iii.   Pumping station, ground water recharge areas.

iv.   Electric substation.

v.   Water works and pumping station, service reservoirs.

vi.   Sanitary refuse shed, refuse transport station.

vii.  Crematorium and Cremation ground.

viii.  Uses where group of people congregate or gather for amusement, recreation, social, religious, patriotic, civil, travel, and similar purpose, for example theatres, museums, skating rings, gymnasium, restaurants, places of worship, dance halls, club rooms, passenger stations and terminal of public transport services, recreation piers and stadia.

ix.   Uses for the purpose such as medical or other treatment or care of persons suffering from physical or mental illness, disease or infirmity, care of infants or aged persons.  These may even provide sleeping accommodation for occupants.

x.    Educational buildings such as college, technical colleges & polytechnic, universities, trade schools etc.

xi.   Government offices, municipal offices.

xii.  Open spaces including

      a. Golf clubs and links.

      b. Public parks, private parks, play fields, summer camps, for recreation of all types.

      c. Race tracks.

      d. Amusement park including amusement devices like giant wheel, roller coaster, merry go round or similar rail or ropeway rider, lake parks, swimming pool, magic mountain and ethnic village, shops for souvenirs, toys, refreshments and beverages with special permission of the Authority.

xiii.  Ancillary uses to all the above uses.

xiv. Solid waste disposal sites.

xv.  Petrol pumps, services stations.

xvi. Sewerage treatment plant, electric substation, water balancing reservoir, overhead reservoirs.

Above uses shall be subject to following conditions

a.   Plot sizes shall conform to the relevant provisions.

b.   Ancillary uses shall be permitted as required.

evelopment of amenities and utilities under the public and semi public zones:

The plan envisages development of amenities by the Appropriate Authority on acquisition / surrender of land to the Authority or the owner taking up their development, voluntarily.

The indicative list of amenities is as follows:

a) Any utility / amenity / public conveniences, as may be decided by the Authority.

b) Educational uses.

c) Health related use, Open spaces and recreational grounds open to the public, municipal markets, small convenience shops with priority being given to those affected by Master Plan reservation.

d) Social facility including library, post office, police station, etc.

e) Administrative offices,

f)  Roads to facilitate better circulation in the area or provide access to hinterland.

4.4. Manufacturing Zone (Non Polluting Service Industries)

In Cyberabad Development Authority area only non polluting service industries are permitted. The units may be permitted in independent building on independent designated plots as per table below.

4.5. Recreational Use Zones

In the Draft Master Plan this Zone is indicated mainly to conserve large open spaces, forest areas, green belts around water bodies and nalas and must be used only for open air activity without any permanent structures except small ancillary buildings.

Unless otherwise shown as special reservation on the Plan, the following uses may be permitted in Recreational Use Zone.

i.     Garden and Poultry Farm, Dairy Farm, Stud Farm, Cattle raising, rain water harvesting, ground water recharge pits.

ii.    Forestry.

iii.   Nurseries.

iv.   Telephone booth and other support facilities with maximum plot size of 500sqm.

 v.   Water Sports.

 vi.  Golf Courses, Maidans, Playgrounds.

vii.  Sports Grounds.

viii.  Sports Complexes.

 ix.  Tennis Courts.

 x.   Gymnasium.

In Recreational use Zone ground floor structures may be used for the purposes of sports and  recreational activities. Clubs, religious and community types of uses can be constructed in such recreational open spaces with built up area not exceeding 10% of the area of the open space in which the same is located and provided further that the open space in which they are located admeasures not less than 800 sqm. The maximum height of such structures shall not exceed 7.0m.  Swimming pool, skating rinks and other paved areas, without any structure, will be permitted in such recreational open spaces and shall not be counted towards the built up area.  5% more area may be used for public utilities such as electric substations, pump house, telephone, milk, news paper booths and library etc.

Excepting the area covered by the structures permissible, entire of the recreational space shall be  kept permanently open to sky.

4.6. Water Bodies

No construction activity is permitted in Water Bodies Use except for Jetties, embankments, temporary Kiosks on the shore and other open air recreational activities and water sports.

4.7. Transportation Use Zone

Following uses are permissible in this zone

i.  All roads

ii.  Godowns, warehouses, cold storage, freight depots, transit sheds, Parking garages, hangers (other than aircraft) and other ancillary uses.

iii. Sheltering including servicing, processing or repairs incidental to storage of goods, wares or merchandises and vehicles.

iv. Bus depots, transport workshops.

v. Support facilities like petrol pumps, police station, post offices, telephone booths and eating joints shall be permitted in this zone.

The uses permitted in this zone shall be subject to following conditions

a. Ancillary uses shall not occupy area not more than 25 percent of the total built-up area.

b. Parking and loading and unloading spaces be provided as per relevant norms.
